Public Notice – Notice of Public Hearing by Tyre Town Board March 16, 2023 6:30 PM

TOWN OF TYRE

                                                   NOTICE OF PUBLIC HEARING

            PLEASE TAKE NOTICE, that a public hearing will be held by the Town Board of the Town of Tyre on March 16, 2023, at 6:30 p.m., at the Tyre Town Hall, 1082 Gravel Road, Seneca Falls, New York, regarding the adoption of a Local Law of the Town of Tyre for the year 2023, which would amend the Zoning Law of the Town of Tyre to do the following:

  • Amend the Agriculture District Regulations to change “public utilities” from a permitted use to a specially permitted use, to change “bed and breakfast”, “dwelling, two family”, “small engine repair” and “wood working/metal shop” from specially permitted uses to permitted uses, to add “short term rental” as a permitted use, to amend the permitted use of “equine operation, private” to read “equine operation” and to add “event center” and “schools” as specially permitted uses.
  • Amend the High Density Residential Regulations to amend the permitted use of “schools, public/private” to read “schools”, to change “bed and breakfast” from a specially permitted use to a permitted use and to amend the specially permitted use of “large-scale solar energy systems” in the Bulk and Use Tables to read “solar energy systems”.
  • Amend the Commercial District West Regulations to amend the permitted use of “gasoline station” to read “fueling station”, to amend the permitted use of “motor vehicle repair shop/station” to read “motor vehicle repair”, to amend the specially permitted use of “large-scale ground-mounted solar PV systems” to read “solar energy systems”, to changed “short term rental” from a specially permitted use to a permitted use and to add “dwelling, single-family” as a permitted use.
  • Amend the Commercial District East Regulations to change “bed and breakfast”, “restaurant” and “retail” from specially permitted uses to permitted uses, to add “short term rental” as a permitted use and to add “bank or financial institution”, “event center”, “laundromat”, “school” and “storage facility” as specially permitted uses.
  • Amend the Mixed-Use District Regulations to add “bed and breakfast” and “short term rental” as permitted uses and to add “school”, “storage facility” and “event center” as specially permitted uses.
  • Amend the regulations dealing with solar energy systems that are exempt from Special Use Permit and Site Plan Approval and adopt new regulations to specify the standards applicable to exempt solar energy systems.
  • Amend the Bulk and Use Tables as follows:

For the Agriculture District, amend the specially permitted use of “Large-Scale Solar Energy Systems” to read “Solar Energy Systems”, change “Dwelling, Two Family”, “Bed and Breakfast”, “Short Term Rental”, “Small Engine Repair” and “Woodworking/Metal Shop” from specially permitted uses to permitted uses and change “Public Utilities” from a permitted use to a specially permitted use.

For the High Density Residential District, amend the specially permitted use of “Large-Scale Solar Energy Systems” to read “Solar Energy Systems” and change “Bed and Breakfast” from a specially permitted use to a permitted use.

For the Commercial District West, amend the specially permitted use of “Large-Scale Solar Energy Systems” to read “Solar Energy Systems” and change “Short Term Rental” from a specially permitted use to a permitted use.

For the Commercial District East, amend the specially permitted use of “Large-Scale Solar Energy Systems” to read “Solar Energy Systems” and change “Bed and Breakfast”, “Short Term Rental”, “Restaurant” and “Retail” from specially permitted uses to permitted uses.

For the Commercial Industrial District, amend the specially permitted use of “Large-Scale Solar Energy Systems” to read “Solar Energy Systems”.

For the Mixed-Use District, amend the specially permitted use of “Large-Scale Solar Energy Systems” to read “Solar Energy Systems” and change “Bed and Breakfast” and “Short Term Rental” from specially permitted uses to permitted uses.

            Any resident of the Town of Tyre shall be entitled to be heard upon said proposed Local Law at such public hearing.  Copies of said proposed Local Law are available for public review at the Town of Tyre Town Hall, 1082 Gravel Road, Seneca Falls, New York.
