NOTICE IS HEREBY GIVEN that the End of Year Meeting of the Tyre Town Board will be held on Thursday, December 31, 2020 beginning at 6:30 p.m. at the Tyre Municipal Building located at 1082 Gravel Road, Seneca Falls, N.Y. 13148 in the Town of Tyre, Seneca County.

PLEASE TAKE FURTHER NOTICE that this meeting topic is not exclusive and that the Tyre Town Board may consider other matters properly brought before it.

COVID-19 CLOSURES AFFECTS TOWN OF TYRE 2021 PROPERTY TAX RATE

The PROPERTY TAX RATE for the Town of Tyre was $9.84 per thousand dollars of taxable value in 2016. del Lago Resort and Casino was officially opened on February 1, 2017. With the projected revenue from del Lago, the Property Tax Rate for 2017 was reduced by 50% to $4.90 per thousand dollars of taxable value. 

Based on del Lago’s performance during 2017, the Property Tax Rate for 2018 was reduced again by nearly 50% to $2.50 per thousand. The Property Tax Rate for 2019 was further reduced to $2.25 and in 2020, it was reduced again to $1.63 per thousand.

Due to the current reported Coronavirus Pandemic, del Lago had faced a mandatory closure from mid-March until the Governor allowed the casino to reopen at 25% capacity on September 09, 2020. During this closure period, the Town of Tyre did not receive any of its allotted Gaming Tax Revenue from New York State. This loss of revenue is estimated to exceed 1 million dollars, significantly affecting the 2020 budget.

New York State Town law requires that the Town Clerk present a Tentative Budget for the following year by September 30 and it is to be adopted by the Town Board by November 20. The Town of Tyre’s Tentative Budget for 2021 was presented and accepted and then adopted as the Preliminary Budget by the Town Board at the Tyre Town Board meeting held on September 17, 2020.

Due to the uncertainty of del Lago’s performance for the remainder of 2020, and due to the ongoing reported COVID Pandemic along with very restrictive New York State regulations and guidelines, the Town has had to be especially conservative in the development of its 2021 budget. In setting the 2021 Tentative Budget, the Town of Tyre has opted not to include any projected revenues to be received from Gaming Tax Revenue in 2021. In effect, this has currently resulted in a Property Tax Rate of $5.66 per thousand dollars of taxable value for 2021, which is still $4.18 less than the pre-casino Tyre Property Tax Rate of 2016. Due to conservative budgeting with reserves over the past three years, the Town was able to hold the Property Tax Rate down from a much larger increase at the current time.

The Town expects that as the capacity limit is allowed to increase for the casino, their attendance and their performance should return to pre-shut down figures and the Town of Tyre will once again be able to reduce future property tax rates.

PUBLIC HEARING NOTICE

          NOTICE IS HEREBY GIVEN, that a public hearing pursuant to Town Law Section 184 will be held by the Town Board of the Town of Tyre, New York at the Town of Tyre Town Hall, 1082 Gravel Road, Seneca Falls, New York 13148 on the November 19, 2020 at 6:30 p.m. prevailing time for the purpose of considering the contracting with one or more entities maintaining adequate and suitable apparatus and appliances for the furnishing of fire protection and emergency services within the Tyre Fire Protection District for the year 2021 upon the following general terms, to-wit: that the contracting entity or entities shall answer and attend upon all calls in said Town of Tyre Fire Protection District; that the consideration for such contract or contracts shall be in the total amount of one hundred fifty-five thousand dollars; together with such other incidental terms as may be necessary or proper in connection with such contracting for fire protection and emergency services.

          At such hearing, at which time and place said Town Board will consider such and hear all persons interested in the same and that a copy of the terms of the proposed contract may be inspected at the Town of Tyre Town Clerk’s Office during regular business hours.

NOTICE OF PUBLIC HEARING

NOTICE IS HEREBY GIVEN that the Town of Tyre 2021 Preliminary Budget, the Tyre Fire Protection District 2021 Preliminary Budget, the Tyre Water District #1 2021 Preliminary Budget, the Tyre Water District #2 2021 Preliminary Budget for the fiscal year beginning January 1, 2021 have been completed and filed in the office of the Tyre Town Clerk, 1082 Gravel Rd, Seneca Falls, NY 13148, in the Town of Tyre, where these are available for inspection by any interested person during normal business hours.

FURTHER NOTICE IS HEREBY GIVEN that the Town Board of the Town of Tyre will meet and review said Town of Tyre 2021 Preliminary Budgets and hold a Public Hearing thereon at the Tyre Municipal Building, 1082 Gravel Rd, Seneca Falls, NY 13148, in the Town of Tyre, at 6:30 pm. on the 5^th day of November 2020, and that said hearing, any person may be heard in favor of, or against, any item or items therein contained.

REGARDING PROPOSED LOCAL LAW NO. 2 OF 2020 ENTITLED “TO OVERRIDE THE TAX LEVY LIMIT ESTABLISHED IN GENERAL MUNICIPAL LAW SEC. 3-C AS IT PERTAINS TO THE TYRE TOWN BUDGET FOR THE FISCAL YEAR COMMENCING JANUARY 1, 2021”

PLEASE TAKE NOTICE, that a public hearing will be held by the Town of Tyre Town Board at the Tyre Municipal Building, 1082 Gravel Road, Seneca Falls, NY 13148 in the Town of Tyre, on November 05, 2020 at 6:35 P.M. for the purpose of hearing public comments on proposed Local Law No.2 of 2020, which law would allow the Town of Tyre to override the tax levy limit established in New York State General Municipal Law Section 3-C as it pertains to the Tyre Town Budget for the fiscal year commencing January 1, 2021.

NOTICE OF AREA VARIANCE REQUEST, TOWN OF TYRE

Notice is hereby given that the Town of Tyre Zoning Board of Appeals will meet at 6:30 PM, October 13, 2020, at the Tyre Municipal Building on located at 1082 Gravel Road Seneca Falls, NY 13148, in the Town of Tyre, Seneca County.  Town resident Tim Rease have applied for a variance to the side yard setback for a 30’ by 60’ proposed building located at 1720 State Route 318 (Tax Map 15-1-01.2). The Tyre Zoning Law (Appendix A: Bulk and Use Tables) requires a 30’ side yard setback for buildings in the Commercial West Zoning District.  The applicants propose a 5’ setback for the proposed building. The purpose of the meeting is to hold a public hearing.

The Tyre Zoning Board of Appeals invites written comments to be submitted regarding the proposed Love’s Travel Center project and any potential related environmental impacts of concern by sending comments to the Tyre Municipal Building, 1082 Gravel Road, Seneca Falls, NY 13148 and invites written and oral comments at the aforementioned Public Hearings. Those wishing to provide comment on these subjects should submit written comments to the Town of Tyre within 24 hours of the date and time specified.

NOTICE IS HEREBY GIVEN that the Town Board for the Town of Tyre will hold a Special Meeting for the purpose of holding a 2021 Budget Workshop for Budget Year 2021 at the Town of Tyre Municipal Building, 1082 Gravel Road, Seneca Falls NY 13148 on Thursday, October 8, 2020 beginning at 6:30 p.m. The purpose of this workshop is to review initial departmental budgets, committee requests and funding requests from outside agencies for the budget year 2021.

This meeting is open to the public and all interested persons are encouraged to attend.
