NOTICE IS HEREBY GIVEN that the Town Board for the Town of Tyre will hold a Special Meeting for the purpose of holding a 2022 Budget Workshop for Budget Year 2022 at the Town of Tyre Municipal Building, 1082 Gravel Road, Seneca Falls NY 13148 on Thursday, October 07, 2021 beginning at 6:30 p.m. The purpose of this workshop is to review initial departmental budgets, committee requests and funding requests from outside agencies for the budget year 2022.
This meeting is open to the public and all interested persons are encouraged to attend.
FURTHER NOTICE IS HEREBY GIVEN that immediately following the Budget Workshop described above, the Town Board may consider any additional business that is properly brought before it.
NOTICE IS HEREBY GIVEN that the Tyre Town Board will have a special Town Board meeting on Thursday, September 02, 2021, beginning at 6:30 p.m. at the Tyre Municipal Building located at 1082 Gravel Road, Seneca Falls, N.Y. 13148 in the Town of Tyre, Seneca County for continued discussion on the existing contract for Fire Protection and Emergency Services within the Tyre Fire Protection District for the year 2021.

NOTICE IS HEREBY GIVEN, that a public hearing pursuant to Town Law Section 184 will be held by the Town Board of the Town of Tyre, New York at the Town of Tyre Municipal Building, 1082 Gravel Road, Seneca Falls, New York 13148 on August 19, 2021 at 6:30 p.m. prevailing time for the purpose of considering the amendment of the existing contract for the furnishing of fire protection and emergency services within the Tyre Fire Protection District for the year 2021 upon the following general terms, to-wit: that the contracting entity or entities shall answer and attend upon all calls in said Town of Tyre Fire Protection District; that the consideration for such contract or contracts shall be in the total amount as set forth in such amended contract; together with such other incidental terms as may be necessary or proper in connection with such contracting for fire protection and emergency services.
At such hearing, at which time and place said Town Board will consider such and hear all persons interested in the same and that a copy of the terms of the proposed contract may be inspected at the Town of Tyre Town Clerk’s Office during regular business hours.
Mr. Jared Hammer, Director of Transactions & Market Strategy from Delaware River Solar requested to speak at the meeting to discuss their proposal for a solar project on Gravel Road in the Town of Tyre.
Ms. Karen Burcroff, Project Director, Seneca County Substance Abuse Coalition requested to speak at the meeting to discuss the NYS Cannabis Law.
On April 28, 2021, Delaware River Solar (DRS) approached the Town to present an introduction and conceptual plan to build a 1,600 acre solar farm in the Town of Tyre.
You may be aware that on the Seneca Falls, NY side of NYS Rt. 318, there is currently a solar farm under construction there in our neighboring town. This letter is to inform you of a proposal here in the Town of Tyre.
At the point of this writing, the developers have notified the Town that they have secured a total of 932acres through land leases with 4 property owners in Tyre. Their intention is to secure another 668 acres, through landowner leases. DRS indicated that their specific target area is Gravel Road and its vicinity. As can be seen below, we have included a map which was given to the Town by the developer, outlining the projected area.

Please note that New York State has enacted a new procedure for these large scale solar farms to obtain permits for their plans and construction. On April 03, 2020, NYS passed the Accelerated Renewable Energy Growth and Community Benefit Act. Governor Cuomo has pursued his initiative of fast tracking this permitting process with a board he has developed entitled the “Office of Renewable Energy Siting (ORES)”. Accordingly, ORES was developed in keeping with the Governors “nation-leading clean energy and climate goals”, including his directive to obtain 70% of the state’s electricity from renewable sources by 2030. This process is seen as, “the most aggressive climate and clean energy initiative in the nation, calling for an orderly and just transition to clean energy”, according to the Governor’s September 16, 2020 announcement to combat climate change.
This NYS ORES board was created for large scale energy projects (over 25 megawatts) to review the developers plans and to fasttrack the permit process at the state level. This board is described as follows, “The new siting process provides a one-stop process with increased certainty and predictability to develop renewable energy projects in New York State. The ORES approach proactively addresses the key recurring issues in siting and permitting large-scale renewable projects, effectively de-risking the permitting process”. This was cited in the announcement of Governor Cuomo’s regulations for ORES.
This process previously rested with the localities for the developers to obtain approval or not through the Town and/or Planning Boards. This is a challenging situation for localities due to this new law having been passed. As is being witnessed in various upstate New York municipalities, such as Conquest, NY for example, this new process has been problematic for Towns to attempt and intervene to save their farmlands. In Conquest, NY, the solar farm proposal is for 2,000 acres in a Town with a population not unlike the size of Tyre.
As can be seen throughout Seneca County, there have been several landowners who have leased their lands to different solar companies to build these projects. Fayette, Waterloo, Seneca Falls, are just some of the Towns in our immediate area contending with these projects. Landowners are being offered significant sums of money by these companies to quit farming and turn their properties into solar farms. It has come to our attention that some of these property owners are deciding that the land lease is a better financial proposition than continued farming, or in other cases, business owners are leasing their land as well to the solar companies. Please understand that we do not oppose renewable energy. However, farmland is a very valuable asset. In the end, the decision to forever eliminate this farmland may very well affect all of us with food shortages, skyrocketing food prices, and a lessoned sense of self responsibility in growing, tending to, and keeping our food local. These are difficult decisions for all involved and the homeowners that are surrounding these solar farms will surely be impacted with newfound challenges from potential property values being decreased and quality of life issues as they look out of their windows and no longer see fields of growing crops but instead view fields of solar panels, transforming our landscape forevermore.
Please know that your Town is working diligently to request assistance from Senator Helming and Assemblyman Gallahan to protect the interests of our residents. We continue to ask questions and explore our options. The Town has also secured an environmental attorney to assist in this matter and guide us through this process. Costs for the bulk of these professional services are to be reimbursed by the developer.
DRS has advised the Town that this 1600 acre project in Tyre is their largest project to date. Many questions were asked of the developer during their initial presentation. At this point in time, we have not received many answers to our various questions. DRS was asked to change the name of their project by removing the word “Tyre” from their proposed “Tyre Solar Energy Center” project. They have agreed to do so per our request. We have not been informed as to the new name for this proposed project as of yet.
The Town will be having ongoing discussions with various stakeholders in this process to ascertain the Town’s role in this newly enacted procedure at the state level, considering this new ORES board in Albany, NY is now reviewing all municipal projects larger than 25 megawatts, instead of the local municipalities through their elected boards.
Although the Town has previously enacted a solar law that limits the amount of acreage of large scale solar farms, it is our understanding that the Town will not have the final say in granting permissions to build. That decision will be granted by Governor Cuomo’s ORES board.
It is my intention to INFORM THE RESIDENTS OF TYRE of this massive project. We continue to hold our Town Board meetings in person. I invite all interested parties to have a voice in this matter, and we will take every opportunity to forward our concerns to Albany. I ask for your help and support in this endeavor to work together as a community for the best interests of everyone in our Town.

There has been a lot of time and effort associated with the awarding of the Galen-Clyde contract regarding fire protection for the Town of Tyre. I would like to provide some background information in an effort to explain (and to clear up any misinformation) as to what led us to this current decision and also to take this opportunity to let our community know the facts regarding this particularly important decision.
As can be seen by this resolution below, the Town of Tyre Town Board voted unanimously, to contract with the Galen-Clyde Fire District.

RESOLUTION OF TOWN BOARD OF THE TOWN OF TYRE AUTHORIZING FIRE PROTECTION CONTRACT WITHIN THE TYRE FIRE PROTECTION DISTRICT FOR THE YEAR 2021.
WHEREAS, there has been established in the Town of Tyre a fire protection district known as the “Tyre Fire Protection District” embracing the territory in the whole of said Town wholly outside of any city or village as such territory is more fully described establishing such district duly previously adopted by The Town of Tyre Town Board, and
WHEREAS, it is necessary to enter into a contract for the furnishing of fire protection to the said fire protection district, and
WHEREAS, due notice has been given of a public hearing to be held at the Town of Tyre Town Hall, 1082 Gravel Road, Seneca Falls, New York 13148 on November 19, 2020 at 6:30 p.m. prevailing time to consider a contract for the furnishing of fire protection to the said fire protection district, the notice duly specifying the time and place of the hearing as aforesaid, and giving in general terms the proposed contract, and the said hearing having been held, and all persons interested in appearing having been heard,
NOW THEREFORE, BE IT
RESOLVED, That the Town of Tyre shall contract with the Galen-Clyde Fire District for the furnishing of fire protection to the Tyre Fire Protection District for the period commencing at January 1, 2021 through and including December 31, 2021 for the sum in the total amount of One Hundred Fifty-Five Thousand Dollars ($155,000.00) together with such other terms and conditions as are stated in such contract, a copy of which is attached hereto; and it is further,
RESOLVED, That such contract be executed on behalf of this Board by the Town Supervisor on behalf of members thereof.
The adoption of the foregoing Resolution was moved by Councilman Reginald Aceto, seconded by Councilman Kenneth Sutterby, and duly put to a vote, which resulted as follows:

Throughout the course of the past year it had become increasingly evident that action needed to be taken to assure comprehensive fire protection service to our Town. At one point in time, Magee Fire Chief Craig Reynolds advised the Board that his department had not responded to 4 emergency calls and that he could not give any assurance that Magee firefighters would be able to respond to calls in the future as required in their contract with the Town. This information, in addition to the ongoing reports of nonstop in-fighting within that department, the constant threats to this office of fire fighters planning to quit due to this in-fighting, various New York State Agency Investigations taking place within that department, Workplace Violence Allegations, as well as a multitude of other matters, led to the difficult and heartbreaking decision to look elsewhere for reliable fire protection.
The Town Board then proceeded to seek the advice of Attorney Mark C. Butler in an effort to give us options for moving forward with future fire protection for our residents. Attorney Butler’s specialty is New York State fire department law. It was confirmed by legal counsel that the Town has No Legal Authority to intervene in Magee’s internal struggles. Again, after much research, time and effort, the Town Board decided to move in a different direction and seek an alternative to the Magee Fire Department for fire protection.
As a result, the Town of Tyre has contracted with the Galen-Clyde Fire District for 2021. There has been a tremendous amount of work that has been completed in a noticeably short period of time by the folks in the Galen-Clyde Fire Department. They have been working with Seneca County and Wayne County officials, Local Law Enforcement officials, the NYS Thruway Authority, neighboring fire departments (creating an updated mutual aid agreement), del Lago officials, all the while maintaining a clear and open path of communication with this office keeping us updated on this process. They have met with firefighters from Magee Volunteer Fire Department, offering them training, aswell as outlining the process for them to apply for membership to Galen-Clyde with the associated expectations of their department.
Galen-Clyde’s clear commitment to ensure all stakeholders are being brought to the table, to work together on the same mission, which is to offer fire protection to the Town of Tyre. This has been truly commendable, and at the same time, this work has been respectful of the long standing Magee Fire Department which has been an integral part of this community for so many years.
It has also been quite commendable that Chief Tavano from the Galen-Clyde Fire Department has secured a bay at Petro to house a fire truck. This bay at Petro is being staffed with Volunteer fire fighters as often they can, ready to respond when called. Because of the comprehensive planning and leadership of this department, they have provided Tyre with a quicker response time in the majority of cases, simply because fire fighters are often times at their truck stationed here in Tyre.
We look forward to working with Galen-Clyde and thank everyone involved for their continued commitment and dedication to working as a team to ensure proper and consistent fire protection for our town.

PLEASE TAKE NOTICE the Tyre Town Board finds that its current Zoning Law is in need of updating and revisions in order to address a number of issues that are not sufficiently and clearly dealt with in its current Zoning Law, including, but not limited to: event centers, short term rentals, storage facilities, signs, parking, and bulk and dimensional requirements.
